PFG TAKE DOWN POLICY

PFG endeavors as best as it can to respect the rights and interests of those who visit, access and use  www.passportforgood.com (“Site”) or the PFG App.  PFG also endeavors as best as it can to in good faith respect the rights of others.

The terms herein are in furtherance of the PFG General Terms (“Terms”) of the Site and the PFG App.

The terms not defined herein, are defined in the Terms appearing on the Site and PFG App corresponding to the revision date hereof.

PLEASE TAKE NOTICE THAT PFG DOES NOT VERIFY THE ACCURACY OF OR WHETHER COMMUNICATIONS OR POSTINGS TO OR THROUGH THE SITE OR PFG APP ARE COMPLIANT WITH APPLICABLE LAWS, RULES OR REGULATIONS.

PLEASE TAKE FURTHER NOTICE THAT PFG IS NOT A PARTY TO ANY DISPUTES BETWEEN ONE PERSON/ENTITY AND ANOTHER PERSON/ENTITY AND PFG’S SOLE OBLIGATION IS TO FOLLOW AS BEST AS IT CAN IN GOOD FAITH THE BELOW POLICIES AND PROCEDURES.

INTRODUCTION

In appropriate circumstances, at its sole discretion, PFG may remove or disable access to materials, postings or content on the Site or the PFG App, which are properly reported to PFG as:

  • unlawful,
  • illegal,
  • infringing upon the intellectual property rights of others (including, copyright).
  • abusive, or
  • otherwise inappropriate.

Similarly, PFG may also, at its sole discretion, where properly reported to PFG, remove or disable links or references that are:

  • unlawful,
  • illegal,
  • infringing upon the intellectual property rights of others (including, copyright),
  • abusive, or
  • otherwise inappropriate.

INTELLECTUAL PROPERTY

If you believe that your rights have been violated, in accordance with the above, please notify PFG’s agent by written notice or by E-Mail as follows:

For copyright or intellectual property infringement matters, the notice should be sent to PFG’s IP agent and should comply with applicable laws, rules and regulations and include, the following information:

  1. an electronic or physical signature of the owner or a person authorized to act on behalf of the owner of the copyright or other intellectual property rights allegedly infringed;
  2. an identification and a description of the copyrighted content/material or other intellectual property right that you claim has been infringed, including, a copy of the copyrighted content/material or other intellectual property right or the web page address where the copyrighted content/material or other intellectual property right may be found or verified;
  3. identification of the location on the Site or the PFG App of the alleged infringing, content/material;
  4. your name, address, telephone number and E-Mail address;
  5. a statement by you that you have a good faith belief that the reported content/material at issue is not authorized by you, the copyright or intellectual property owner, or a person authorized to act on behalf of the owner of the copyright or intellectual property right, or the law; and
  6. a statement by you, under penalty of perjury, that the above information in your notification is accurate, and that you are the copyright or intellectual property right owner or authorized to act on behalf of the copyright or intellectual property right owner.

We ask that you submit a separate notice for each instance complained of and where the infringing content/material appear.

Upon receipt of notice, PFG will:

make a good faith effort to give notice of the claimed infringement to the content/material provider for response, and

temporarily remove or disable access to that content/material, subject to applicable laws, rules and regulations.

If the content/material provider does not respond to the notice within ten (10) days, PFG will permanently remove or disable access to that content/material subject to applicable laws, rules and regulations.

If the content/material provider responds to the notice and provides PFG with a reasonable basis, in PFG’s sole discretion and subject to applicable laws: (1) the content/material may remain posted, and (2) the temporarily removal or disabling of access to the content/ material may be lifted. At that point, you may resolve the dispute with the content/material provider directly, and PFG will abide by any final court order disposing of the subject matter in respect to the disputed infringing content/material.

OTHER MATTERS

For all other matters, please notify PFG’s compliance agent by a written notice or by an E-Mail with specific details pertaining only to the matter complained of regarding the Site or the PFG App.

We ask that you submit a separate notice for each instance complained of and where the content/material appear.

Please provide the following information in the complaint:

  1. identification and description of the reported content/material or activity on the Site or PFG App;
  2. location of the reported content/material or activity on the Site or PFG App;
  3. applicable laws, rules and regulations you believe are being violated;
  4. your basis for complaint and supporting evidence;
  5. your signature and contact information (please include name, address and E-Mail contact); and
  6. a statement by you, under penalty of perjury, that the above information in your complaint is accurate and that you have a good faith belief that the reported content/ material or activity are violating the applicable law, rules and regulations.

Complaints not satisfying all of the above requirements will not be processed.

Upon receiving a properly submitted complaint, PFG will make an assessment as to whether it has a reasonable basis in PFG’s sole discretion.

PFG reserves the right, but has no obligation, to refer any reported content/material or activity to appropriate authority as it deems appropriate.

Should PFG determine in its sole discretion, that the complaint does not have a reasonable basis, PFG will accordingly notify the complaining party.

Should PFG determine in its sole discretion, that a complaint has a reasonable basis, it will forward the complaint to the party who posted the content, material or who conducts the reported activity for response.

If PFG does not receive a response within ten (10) days from the party responsible for the reported content/materials or activities, or if PFG receives a response from such a party which does not have a reasonable basis, as determined by PFG, the reported content/ material or activity will be removed, disabled or terminated from the Site and/or PFG App.

Should PFG in its sole determination, determines that the responsible party’s response has a reasonable basis, PFG will forward such response to the complaining party, at which time, it will be the responsibility of the complaining party to address the matter directly with the responding party. PFG will abide by any final court order disposing of the subject matter in respect to the reported content, material or activity.

GENERAL

PFG reserves the right, but has no obligation, to remove any content/material, or terminate any activity for compliance considerations, on its own initiative or as mandated by applicable law, rules, regulations or government authorities.
